APPENDIX A

STATUTORY FRAMEWORK OF THE AGENCY'S WORK

  1.  The statutory framework within which the Agency conducts driving tests is Part III and Part IV of the Road Traffic Act 1988 (as amended) together with the Motor Vehicles (Driving Licences) Regulations 1999 (SI1999/2864).

  2.  In addition, the Agency is responsible for:

    —  the operation and management of the Register of Approved Driving Instructors under Part V of the Road Traffic Act 1988 as amended by the Road Traffic (Driving Instruction by Disabled Persons) Act 1993 together with the Motor Cars (Driving Instruction) Regulations 1989 (SI 1989/2057) (as amended) and, as regards appeals, the Motor Cars (Driving Instruction) (Appeals) Rules 1969 (SI 1969/86) (as amended); and

    —  the authorisation of training bodies and instructors for approved training courses for learner motorcyclists under Part V of the Motor Vehicles (Driving Licences) Regulations 1999 (SI1999/2864).

  3.  European Community regulation of driving licences and related matters is subject to Council directive 91/439/EEC of 29 July 1991, which was adopted on 1 July 1996. Council Directive 96/47/EC of 23 July 1996 and Council Directive 97/26/EC of 2 June 1997 amended this second Council Directive on driving licences.
