This is the text of the Adoption of Sewers Bill, as presented to the House of Commons on 14th February 2001.

Adoption of Sewers Bill
1.Requirement on sewerage undertakers to adopt sewers on application by owners.
2.Short title.





Require sewerage undertakers to adopt all remaining unadopted sewers.

BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-

Requirement on sewerage undertakers to adopt sewers on application by owners.     1. - (1) The Water Industry Act 1991 is amended as follows.
      (2) In section 102 (adoption of sewers and disposal works)-
    (a) in subsection (2), the words "sewer or" shall be omitted in both places where they occur; and
    (b) in subsection (3), the words "or application" shall be omitted.
      (3) After section 102 there shall be inserted the following section-
"Right of owners of sewers to require their adoption by sewerage undertakers.     102A. - (1) Subject to the following provisions of this section, and to section 103 below, the owner, or any of the owners, of any sewer, may, by application to a sewerage undertaker within whose area the sewer is situated, require that undertaker to adopt the sewer.
    (2) Any person who immediately before the adoption of a sewer following an application made under subsection (1) was entitled to use the sewer in question shall be entitled to use it, or any sewer substituted for it, to the same extent as if the application had not been made.
      (3) No application may be made under this section in respect of any sewer the construction of which-
    (a) was completed before 1st October 1937; or
    (b) is completed after the coming into force of the Adoption of Sewers Act 2001."
      (4) In section 103 (adoption of cross-border sewers etc.), after subsection (4) there shall be inserted-
    "(4A) Where an application is made to a sewerage undertaker under section 102A above in respect of a sewer which serves the whole or any part of the area of another sewerage undertaker, the undertaker to whom the application has been made shall give notice of that fact to the other undertaker".
Short title.     2. This Act may be cited as the Adoption of Sewers Act 2001.
