Consequential amendments
 
     1. Section 85 of the Road Traffic Act 1988 is amended as follows-
 
 
    (a) after the entry for "the light passenger vehicle type approval Directive" there is inserted-
 
    ""mobile telephone" means any wireless telegraphy apparatus which is designed or adapted to be capable of-
 
      (a) connection only to a cellular telecommunication system; and
 
      (b) of use while in motion,",
 
    (b) the word "and" is deleted from the entry for "traffic area", and
 
    (c) at the end of the entry for "vehicle part" there is inserted", and
 
    "wireless telegraphy" has the same meaning as in the Wireless Telegraphy Act 1949."
     2. - (1) Schedule 2 to the Road Traffic Offenders Act 1988 (prosecution and punishment of offences) is amended as follows.
 
      (2) After the entry for section 40A of the Road Traffic Act 1988 there is inserted-
 
 
 
"RTA section 40B
 
Using a hand-held mobile telephone
 
Summarily
 
Level 3 on the standard scale
 
Discretionary
 
Obligatory
 
3"
     3. - (1) Schedule 3 to the Road Traffic Offenders Act 1988 (fixed penalty offences) is amended as follows.
 
      (2) After the entry for section 40A of the Road Traffic Act 1988 there is inserted-
 
 
 
"RTA section 40B
 
Using a hand-held mobile telephone."
