    '11A.—(1) It is a defence for a person charged with an offence under paragraph 1 to prove that—

    (a) the conduct to which the charge relates consisted of searching for fox cubs which the defendant reasonably believed were not capable of fending for themselves; and

    (b) the two conditions in paragraph 2 were met.

    (2) The first condition is that the defendant also reasonably believed that the vixen who had nurtured the fox clubs was dead or seriously injured.

    (3) The second condition is that reasonable steps were taken for the purpose of ensuring that as soon as possible after being found that the fox cubs were shot dead or otherwise cared for.'.
